These Terms of Use (“Terms”) govern your use of DeliveryQC (“the Service”), a free, in-browser audio quality-control tool operated by MeterPlugs Audio Inc. (“MeterPlugs”, “we”, “us”, “our”). By using the Service, you agree to these Terms. If you do not agree, please don't use the Service.
The Service
DeliveryQC analyzes audio files in your browser and reports loudness, true-peak, and related measurements, and compares them against streaming and broadcast delivery specifications. It is provided free of charge and without an account.
No warranty and no guarantee of accuracy
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and availability. Measurements, compliance verdicts, and other results are provided for guidance only. Delivery specifications change over time, and results may contain errors or omissions. You are solely responsible for verifying that your audio meets the actual, current requirements of the relevant platform or broadcaster before delivery, and should not rely on the Service as your only means of confirming compliance.
Limitation of liability
To the fullest extent permitted by law, MeterPlugs will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or reliance on, the Service or its results — including rejected deliveries, lost time, or lost revenue. Your use of the Service is at your own risk.
Acceptable use
You agree not to:
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure;
- misuse the feedback form, including submitting unlawful, abusive, or automated content;
- use the Service in violation of any applicable law.
Intellectual property
The Service, including its software, design, and branding, is owned by MeterPlugs and protected by applicable intellectual-property laws. These Terms do not grant you any rights in it other than to use the Service as intended.
Dolby Dialogue Intelligence
Dialog-gated loudness is provided using technology created under license from Dolby Laboratories Licensing Corporation. Use of the Service does not convey a license nor imply a right under any patent, or any other industrial or intellectual property right, of Dolby Laboratories.
Feedback
If you submit feedback through the Service, you grant us the right to use it to operate and improve the Service, without any obligation or compensation to you. See our Privacy Policy for how feedback is handled.
Changes to the Service and these Terms
We may modify or discontinue the Service, and may update these Terms, at any time. Material changes to these Terms will be reflected by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that the courts located in Victoria, British Columbia, Canada will have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.
